  • Provide consulting services to clients in order to bring their practices into compliance with the No Surprises Act, including creating appeals procedures and processes to respond to good faith estimate requests.
  • Represents healthcare providers in underpayment litigation against national insurers in Miami-Dade County.
  • Review network agreements and negotiated terms therein.
  • Resolve ongoing billing and coding issues being experienced by a national provider in several states.

Senior Associate Attorney, Lubell Rosen, 2019-2022

  • Created Lubell Rosen’s Affordable Care Act litigation department and oversaw a large volume of cases filed against national insurers which led to over $4.5M in settlements in 18 months.
  • Argued over three dozen hearings designed to create black-letter law in the ACA arena including seminal Motions to Dismiss, Motions for Summary Judgment and critical motions related to the scope and breadth of allowable discovery.
  • Monitored changes to the healthcare industry which would impact our clients and our litigation strategy at a state & federal level.
  • Guided clients through compliance complaints related to billing & coding issues within their practices.
  • Drafted, reviewed and revised physician employment agreements for all specialties.

  • Represented health care providers including hospital groups, large physician practice groups and acute care facilities in contracting disputes and issues involving payments from managed care companies where the provider is non-par.
  • Managed all complex claim denials for a national hospital chain, both pre-litigation and litigation, increasing recoveries from $25,000 annually to over $3.5m annually in a three year time span.
  • Created departments within the firm to process workers’ compensation and personal injury claims on behalf of hospital clients from intake through billing and follow up.
  • Retained and oversaw outside counsel in different states to file suit on clients’ behalf in healthcare contracting disputes.
