Carlos Arce is a Florida and D.C. licensed attorney with a background in the business of healthcare. His legal experience spans from healthcare law, mergers & acquisitions, business transactions, and healthcare regulatory matters. He practices with unique insights gathered from his personal business management of medical clinics, and various positions as in-house and out-of-house counsel for healthcare groups. He represents:

Carlos has spent his legal career practicing with high profile South Florida law firms and has developed a reputation among his peers for his ethics and integrity in practice. Carlos has worked closely with many medical practices and healthcare clinics and has had the opportunity of owning his own healthcare clinic.

Carlos has been involved in numerous healthcare transactions, and has experience in the following:

  • Contracts, i.e. leases, managed care arrangements, employment agreement, independent contractor agreements, MSO agreements, and DSO agreements;
  • Organizational documents for medical practices (operating agreements, shareholder agreements, and limited partnership arrangements);
  • Analyzing the applicability of the Anti-Kickback Statute, the Stark Law, and other state and federal fraud and abuse laws, rules, and regulations to proposed transactions and business arrangements;
  • Establishing and supporting implementation of compliant policies & procedures for medical practices (HIPAA and Privacy Law policies and procedures, employment policies and procedures, and patient intake forms);
  • Insurance Regulations and Disputes;
  • Medicare and Medicaid Advisement;
  • Payor Audit Defense (SIU audits, Medicare Audits, Medicaid Audits, and Manage Care Audits); and
  • Mergers & Acquisitions (Seller and Buyer representations, and healthcare regulatory audits over potential mergers and acquisitions).

Carlos received his Bachelor of Arts degree from Florida International University. He received his Juris Doctor degree from the Nova Southeastern University with a concentration in Health Law.
